Terms of Service

Please read these Terms of Service ("Terms") carefully. By creating an account or using SourceStream, you agree to these Terms.

1. Acceptance of Terms

By using SourceStream at sourcestream.io ("the Service"), you agree to these Terms and our Privacy Policy. If you are acting on behalf of an organisation, you confirm you have authority to bind that organisation, and "you" refers to both you and the organisation.

If you do not agree, do not use the Service.

2. Description of Service

SourceStream is a marketing attribution platform that helps businesses understand which marketing channels drive their leads. The Service includes:

• A JavaScript tracking script that captures attribution data (referrer, UTM parameters, landing pages, ad click identifiers) using a first-party cookie.
• Automatic population of hidden form fields with attribution data when visitors submit forms.
• A web dashboard for viewing attribution reports, managing tracking scripts, and configuring integrations.
• APIs and integrations for connecting attribution data to CRMs and other tools.

3. Account Registration and Responsibilities

3.1 Registration

You must create an account with a valid email address and password. You agree to provide accurate and complete information.

3.2 Account Security

You are responsible for keeping your credentials secure and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorised access. We are not liable for loss or damage from unauthorised use of your account.

3.3 Account Requirements

You must be at least 16 years old to create an account.

4. Subscriptions and Billing

4.1 Plans and Pricing

SourceStream offers the following subscription plans:

All prices are in US Dollars. We will give at least 30 days notice of any pricing changes to existing subscribers.

4.2 Billing

Subscriptions are billed monthly in advance via Stripe. By subscribing, you authorise recurring monthly charges until you cancel.

4.3 Cancellation

You may cancel at any time from your account dashboard. On cancellation:

• Your subscription stays active until the end of your current billing period.
• You will not be charged again.
• Your data is kept for 30 days after the subscription ends, then deleted.
• No partial refunds are given for unused time.

4.4 Refunds

We do not generally provide refunds. If you believe you were charged in error, contact [email protected] and we will review your case.

4.5 Failed Payments

If a payment fails, we will retry over the following days. If payment still cannot be collected, your account may be downgraded or suspended.

5. Free Trial

New subscriptions include a 14-day free trial with full access to all features.

• At the end of the trial, you must select a paid plan to continue.
• If you do not subscribe, your account will be deactivated. Your data will be retained for 30 days.
• We may modify or discontinue free trial offers at any time.

6. Acceptable Use Policy

You agree to use SourceStream lawfully and responsibly. You may not:

• Violate any law or regulation, including data protection, privacy, and anti-spam laws.
• Track users without proper disclosure, such as failing to mention tracking technologies in your website's privacy policy or failing to obtain consent where required by law.
• Collect sensitive personal data through SourceStream (health, financial, biometric, or similarly sensitive information).
• Use the Service on websites directed at children under 13 without appropriate parental consent.
• Scrape, crawl, or harvest data from the SourceStream platform or interfere with its operation.
• Reverse-engineer, decompile, or disassemble the tracking script or platform software.
• Resell, sublicense, or redistribute the Service without written permission.
• Use the Service for fraud, impersonation, spam, or any activity that could harm SourceStream or its users.
• Exceed reasonable usage limits or degrade performance for other users.
• Attempt unauthorised access to other accounts or SourceStream's systems.

Violations may result in immediate suspension or termination of your account.

7. Intellectual Property

7.1 SourceStream's Intellectual Property

The Service — including the tracking script, dashboard, APIs, documentation, and design — is owned by SourceStream. You receive a limited, non-exclusive, non-transferable, revocable licence to use it under these Terms.

7.2 Feedback

If you provide feedback or suggestions about the Service, you grant us a non-exclusive, royalty-free, perpetual right to use that feedback in our products without obligation to you.

8. Data Ownership

You own your data. All attribution and lead data collected through SourceStream belongs to you.

• You grant us a limited licence to process your data solely to provide the Service.
• You can export your data at any time through the dashboard or API.
• On termination, you may request a data export before deletion (see Section 14).

We may use aggregated, anonymised data (that cannot identify you or your visitors) to improve the Service and produce industry benchmarks.

9. Privacy and Data Protection

Our handling of personal data is governed by our Privacy Policy. Our Data Processing Agreement applies if you process personal data of website visitors through SourceStream.

As a customer, you are responsible for:

• Ensuring your use of SourceStream complies with applicable privacy laws.
• Disclosing the use of SourceStream's tracking script in your website's privacy policy.
• Obtaining any required consent from your website visitors before deploying tracking technologies.
• Handling data access or deletion requests from your website visitors regarding data collected through SourceStream.

10. Service Availability

We aim for high availability but do not guarantee uninterrupted or error-free operation.

• We may perform scheduled maintenance with advance notice when possible.
• We are not liable for downtime caused by factors beyond our control, including internet outages, third-party failures, or force majeure events.
• We may modify or discontinue features at any time, with reasonable notice for material changes.

11. Third-Party Services

SourceStream may integrate with third-party services (CRMs, form builders, analytics tools). We are not responsible for those services. Your use of them is governed by their own terms.

12. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
• SourceStream's total liability for all claims related to the Service is limited to the amount you paid us in the twelve (12) months before the claim.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless SourceStream and its officers, employees, and agents from any claims, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service.
• Your breach of these Terms or any applicable law.
• Your infringement of any third-party rights, including your visitors' privacy rights.

14. Termination

14.1 By You

You may cancel your subscription and close your account at any time from your account settings or by emailing [email protected].

14.2 By Us

We may suspend or terminate your account if:

• You violate these Terms or the Acceptable Use Policy.
• Your account has been inactive for an extended period.
• We are required to do so by law.
• We discontinue the Service (with at least 60 days notice).

14.3 Effect of Termination

On termination:

• Your access to the Service ends immediately.
• The tracking script will stop collecting data.
• You have 30 days to request a data export.
• After 30 days, your data will be permanently deleted.
• Sections 7, 8, 12, 13, and 15 survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws of South Australia, Australia.

Any dispute should first be resolved through good-faith negotiation. If unresolved within 30 days, it will be submitted to the courts of South Australia, Australia, which have exclusive jurisdiction.

Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. For material changes:

• We will update the "Last updated" date above.
• We will email you at least 30 days before changes take effect.
• Continued use after the effective date means you accept the revised Terms.
• If you disagree, you may cancel before the effective date.

17. General Provisions

• Entire Agreement: These Terms, the Privacy Policy, and the DPA (where applicable) are the entire agreement between you and SourceStream regarding the Service.
• Severability: If any provision is found unenforceable, the rest remain in effect.
• Waiver: Not enforcing a right does not waive it.
• Assignment: You may not assign your rights without our consent. We may assign ours in connection with a merger, acquisition, or asset sale.
• Force Majeure: Neither party is liable for delays caused by events beyond reasonable control.
